Small Union Sheet metal Manufacturer Successful against Local Union in Federal Court
Attorney Haytham Faraj filed a federal lawsuit and a motion for a temporary restraining order in the U.S. District Court for the Northern District of Indiana, on behalf of Pro Fab Sheet Metal Inc., a Northern Indiana manufacturer of made-to-order commercial duct work.
The lawsuit and motion for a restraining order against the local sheet metal worker's union alleges that the union improperly removed union labels from Pro Fab without cause or warning. Pro Fab is a union shop that uses the labels to identify its products as union made.
Without the labels, their product is indistinguishable from non-union made products. The federal judge found for Pro Fab and issued an order forcing the union to return the labels. In its lawsuit, Pro Fab alleges that local union business agents are using intimidation and coercive tactics to force the company to hire friends of the local union bosses rather than the union employees currently working for Pro Fab.
